Spinal cord injury cases require a careful accounting of medical needs, lost earning capacity, and the support someone may need throughout life. Attorney Luis Guerrero leads our direct, down-to-earth approach and explains each stage in clear language.

Our clients receive their attorney’s personal cell phone number, can reach us on weekends, and get updates throughout their cases. In our first year, we secured over $1 million in settlements and verdicts for clients.

Common Causes of Spinal Cord Trauma in San Antonio

Damage to the spinal cord can disrupt communication between the brain and the body. Depending on its location and severity, a person may experience limited mobility, loss of sensation, or paralysis. We handle spinal cord injuries and paralysis as catastrophic injury cases, along with traumatic brain injuries, severe burns, and amputations.

Vehicle crashes are a common cause, particularly serious collisions on San Pedro Avenue, Loop 1604, I-10, Loop 410, and I-35. These injuries may also result from falls, industrial or oilfield accidents, or medical malpractice. How the injury occurred determines who may be responsible and which legal rules apply.

Compensation for a Life-Changing Injury

Texas law allows claimants to seek damages for both financial losses and the human impact of a catastrophic injury. The compensation available depends on the evidence, responsible parties, insurance coverage, and individual circumstances.

Potential damages may include:

  • Past and future medical bills
  • Lost wages and reduced earning capacity
  • In-home care and adaptive equipment
  • Pain and suffering and mental anguish
  • Physical impairment and loss of enjoyment of life

Insurers often fight harder when a case involves substantial future losses. We use life-care planning to document anticipated care and support needs. Vocational and economic experts can assess how physical limitations affect employment, future earnings, and long-term financial stability.

Texas Filing Deadlines & Comparative Fault

Texas Civil Practice and Remedies Code Section 16.003 generally allows two years from the date of injury to file a lawsuit. Exceptions can affect that deadline, so waiting to investigate can create unnecessary risk.

Texas also applies modified comparative fault under Section 33.001. A claimant’s compensation is reduced by their assigned percentage of responsibility, and someone found more than 50 percent responsible generally can’t recover.

Medical malpractice cases follow separate requirements under Chapter 74, including a different limitations framework under Section 74.251 and caps on non-economic damages under Section 74.301. Those rules apply to malpractice-based cases, not every spinal cord injury.

Workplace Injuries & Nonsubscriber Employers

Texas doesn’t require most private employers to carry workers’ compensation insurance. A business that opts out is called a nonsubscriber employer. Depending on how an industrial or oilfield injury occurred, a worker may be able to pursue a lawsuit against a nonsubscriber employer or a claim against a contractor, property owner, or equipment manufacturer.

Claims involving government entities have separate notice requirements and damage limits. For claims against the state government, total damages are generally capped at $250,000 per person or $500,000 per incident. Different caps can govern claims involving local government entities.

Fatal Injuries & Family Claims

When damage to the spinal cord proves fatal, Texas Civil Practice and Remedies Code Section 71.004 generally permits the surviving spouse, children, and parents to bring a wrongful death claim. This action addresses losses suffered by eligible family members.

Section 71.021 also allows the deceased person’s underlying injury claim to survive the death. The estate can pursue that survival claim, which is legally distinct from the family’s wrongful death action.

How We Build & Pursue Your Case

We begin with an initial consultation to understand what happened and identify the parties who may bear responsibility. We then investigate the available evidence and gather the medical documentation needed to establish the nature and consequences of the injury.

Once we have documented the losses, we submit the claim to the insurer and negotiate for a fair agreement. If the dispute can’t be resolved, we can file a lawsuit in the appropriate Bexar County court. We regularly handle contested claims in the San Antonio area and keep clients informed as their cases move toward a possible trial.

Throughout the process, we explain legal terms in straightforward English or Spanish. Clients can contact their attorney directly and get clear answers about where the case stands.

  • In Texas, you typically have two years from the date of the injury to file a lawsuit. However, in catastrophic injury cases, early legal action is especially important because critical evidence can disappear, and witnesses’ memories can fade. Prompt legal help can also secure access to medical care and financial support while the case progresses.

  • Yes. In many catastrophic injury cases, spouses and sometimes other close family members may be able to seek compensation for loss of consortium, emotional distress, and the burden of caregiving. A knowledgeable attorney can help determine whether family members have valid claims in addition to the injured person.

  • Liability depends on how and where the injury occurred. It could involve a negligent driver, an employer who failed to provide a safe workplace, a property owner who failed to address dangerous conditions, or a manufacturer of defective equipment. A thorough investigation is needed to identify all potentially responsible parties and ensure they’re held accountable.

  • Catastrophic injury claims involve much higher stakes. They often require extensive medical documentation, expert testimony, and life care planning to calculate future costs. Because the damages are so significant—both financial and emotional—insurance companies are more likely to fight hard to avoid paying. That’s why these cases demand experienced legal representation.

  • In legal terms, a catastrophic injury is one that results in long-term or permanent disability, disfigurement, or loss of a critical bodily function. Common examples include traumatic brain injuries, spinal cord injuries, amputations, severe burns, and paralysis. These injuries often require lifelong care and dramatically alter the victim’s quality of life.
